The Department of the Treasury, on 20 May 2021, announced that it would require any transfer worth $10,000 or more to be reported to the Internal Revenue Service since cryptocurrency already posed a problem where illegal activity like tax evasion was facilitated broadly. This release from the IRS was a part of efforts to promote better compliance and consider more severe penalties for tax evaders.
In March 2021, South Korea implemented new legislation to strengthen their oversight of digital assets. This legislation requires all digital asset managers, providers and exchanges to be registered with the Korea Financial Intelligence Unit in order to operate in South Korea. Registering with this unit requires that all exchanges are certified by the Information Security Management System and that they ensure all customers have real name bank accounts. It also requires that the CEO and board members of the exchanges have not been convicted of any crimes and that the exchange holds sufficient levels of deposit insurance to cover losses arising from hacks.
Darknet markets present challenges in regard to legality. Cryptocurrency used in dark markets are not clearly or legally classified in almost all parts of the world. In the US, bitcoins are regarded as „virtual assets“. This type of ambiguous classification puts pressure on law enforcement agencies around the world to adapt to the shifting drug trade of dark markets.
The incidents seem to have prompted the moves to propose accounting and reporting guidance for crypto assets, as Reuters reported last year. In the EU, rules were being worked on before the bankruptcy of crypto exchange FTX.
CBDCs, cryptocurrencies and stablecoins are all distinct, and they could continue to coexist. It is therefore important for consumers to understand the differences between these concepts, as well as the ways they could interact and impact one another.
Britain is actively building rules for the crypto sector. Of note, it has mandated that any company offering a digital currency has to be authorized by the country’s Financial Conduct Authority (FCA).
By mid September, US President Donald Trump announced tariffs on $250 billion worth of Chinese imports, while threatening a further $267 billion-worth. In 2017 China exported $505.5 billion in goods and services to the US, versus $130 billion from the US to China. China has vowed to retaliate with counter-tariffs. But as the smaller importer, China will need to go beyond its trade ammunition. One strategic move China could make is to release its dark horse: a digitalized renminbi (RMB).

At the end of June 2022, the Council presidency and the European Parliament reached a provisional agreement on the markets in crypto assets (MiCA) proposal which covers issuers of unbacked crypto assets, and stablecoins, as well as the trading venues and wallets where crypto assets are held. This regulatory framework is intended to protect investors and preserve financial stability while allowing innovation and fostering the attractiveness of the crypto asset sector. The purpose of MiCA is to provide more clarity across the European Union, as some member states already have varying national legislation for crypto assets, but there had been no specific regulatory framework at an EU level.

While the most famous volte-face on policy towards crypto and blockchain belongs to JPMorgan, they are no longer alone among major financial institutions in embracing Web3. Arguably, just as boards and executive teams reluctantly owned their cybersecurity and digital transformation mandates, the embrace of crypto technology is equally inevitable, even if the term feels like a bad word. For all its faults, this technology remains a protagonist in the global financial world.
For a truly global coordinated approach, countries and international organizations must work together, leveraging best practices and learnings from each other. As well as risk assessments and establishing common standards, there is also a pressing need to leverage the technology itself to develop fit for purpose and inclusive solutions, through public-private collaboration.
While the underlying technology of cryptography and blockchain is generalizable to all industries and coordinating activities (collectively the building blocks of Web3), experimentation at the core of financial services, among other sectors, continues unabated. Indeed, as a test of the staying power of digital assets and blockchains at the core of financial services (and other areas of the global economy), watch what the big banks and mature financial services firms do, not what they say.
